1. Introduction and Acceptance of Terms

Welcome to the Hariri Acupuncture & Wellness website (the “Site”). By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and Privacy Policy (collectively, this “Agreement”). If you do not agree with any part of these terms or our privacy practices, do not use this Site. Use of the Site is also subject to all applicable laws and regulations. This Agreement is a legally binding contract between you (“you” or “User”) and Hariri Acupuncture & Wellness (“the Company,” “we,” “us,” or “our”).

By using the Site, you affirm that you are at least 18 years old or have the consent of a parent or legal guardian. If you are using the Site on behalf of an organization or another person, you represent that you have authority to bind that entity to this Agreement. This Agreement may be updated from time to time, and your continued use of the Site after changes indicates acceptance of the revised terms. The “Last Updated” date above indicates when this Agreement was last modified.

2. Definitions

For the purposes of this Agreement, the following terms have the meanings given below:

  • “Site” refers to the website of Hariri Acupuncture & Wellness, including all content, features, and services provided through it.

  • “Services” refers to the wellness, acupuncture, and related services and information offered by Hariri Acupuncture & Wellness through the Site.

  • “User” (also “you” or “your”) means any individual or entity who accesses or uses the Site.

  • “Personal Information” means information that identifies, relates to, describes, or is reasonably capable of being associated with an identifiable individual. For example, this can include a person’s name, email address, phone number, and IP address. (Personal Information as used here has the meaning given under California lawoag.ca.gov.)

  • “Protected Health Information (PHI)” means individually identifiable health information as defined under the Health Insurance Portability and Accountability Act (HIPAA). 

  • “Third-Party Services” refers to external services or platforms not operated by us that may be integrated with or linked from our Site (for example, scheduling or analytics tools).

Any other capitalized terms in this Agreement have the meanings defined in context. These definitions apply whether terms appear in singular or plural form.

3. Website Content and Intellectual Property

All materials on the Site, including but not limited to text, graphics, logos, images, audio/video content, design, and software (collectively, “Content”), are the property of Hariri Acupuncture & Wellness or its content suppliers and are protected by copyright, trademark, and other intellectual property laws. The compilation of all content on this Site is our exclusive property. Hariri Acupuncture & Wellness and associated logos or slogans are proprietary trademarks/service marks of our company. Unauthorized use of our trademarks or confusingly similar marks is prohibited.

License to Use Site: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content for your personal, non-commercial informational purposes only. You may print or download portions of the Site content for personal use (for example, printing a blog article for reference) but you may not otherwise copy, reproduce, republish, upload, post, transmit, distribute, sell, or create derivative works from any Content without our prior written permission. All rights not expressly granted in this Agreement are reserved by us. If you wish to request permission for any other use of the Content, please contact us (see Contact Information below).

You also agree not to remove, obscure, or alter any copyright, trademark, or other proprietary rights notices displayed on the Site or in the Content. Any unauthorized use of the Site or Content may violate intellectual property laws and will be grounds for termination of the license granted herein.

4. User Responsibilities and Acceptable Conduct

We expect all Users to use our Site responsibly and ethically. By using the Site, you agree NOT to engage in any of the following prohibited activities:

  • Illegal or Harmful Activities: Do not use the Site for any purpose that is unlawful or prohibited by this Agreement. You agree not to post or transmit any content that is illegal, fraudulent, harassing, defamatory, obscene, or otherwise objectionable. This includes refraining from any hate speech or discrimination against any individual or group (we strictly prohibit discrimination on the basis of characteristics such as race, color, religion, gender, sexual orientation, age, national origin, disability, etc., in accordance with California’s Unruh Civil Rights Actreciteme.com).

  • Security Violations: Do not attempt to interfere with the proper functioning of the Site. You must not knowingly introduce viruses, malware, or any other harmful code. You agree not to attempt to gain unauthorized access to any portion of the Site, accounts, computer systems, or networks connected to the Site, through hacking, password mining, or any other illegitimate means.

  • Privacy Violations and Impersonation: Do not violate the privacy or rights of others. You agree not to collect or harvest personal information of other users from the Site without proper consent. Impersonation of any person or entity, or misrepresenting your affiliation with a person or entity, is strictly prohibited.

  • Content Submission Standards: If you submit any information or materials to us (for example, through a contact form or testimonial form), you agree that such submissions will be lawful, truthful, and not violate any third-party’s rights. You must not upload or send any content that contains proprietary material of others (including copyrighted material) unless you have permission, nor any content that violates confidentiality or privacy rights.

  • No Disruption: You will not use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission. You also agree not to engage in practices that impose an unreasonable load on our infrastructure or interfere with the normal operation of the Site (such as denial-of-service attacks or spamming).

We reserve the right to monitor usage of the Site to enforce these rules. Violations of these conduct standards may result in suspension or termination of your access to the Site, and if appropriate, we may report violators to law enforcement or pursue legal action. You are responsible for any content you post or actions you take on the Site and for ensuring that your use complies with all applicable laws and regulations.

5. Privacy Policy

Your privacy is important to us. This Privacy Policy section explains what information we collect through the Site, what we do not collect, how we use and share that information, and your rights regarding your data. By using the Site or submitting information to us, you consent to the data practices described here. This Privacy Policy applies only to information collected through our website (haririacupuncture.com) and not to any information collected offline or through other services not controlled by us (such as third-party booking platforms or in-person clinic visits).

5.1 Information We Collect

Personal Data You Provide: We may collect personal information that you voluntarily provide to us via the Site. This includes, for example:

  • Contact Information: If you fill out a contact or inquiry form, sign up to request information, or submit a testimonial, we may collect your name, email address, phone number, or other contact details you provide.

  • Inquiry Details: Any information you choose to include in the message or testimonial you send us (such as the content of your inquiry, feedback, or testimonial). We advise you not to include sensitive personal details in these submissions. (Notably, please do not submit any medical or health history details via general website forms, as the Site is not intended to collect healthcare or treatment information.)

Information Collected Automatically: When you visit our Site, we (or our third-party analytics providers) may automatically collect certain technical information about your visit. This includes:

  • Usage Data: Details of your visits to our Site, such as the pages or content you view, the dates and times of access, the amount of time spent on pages, and referring website addresses. For example, we use Google Analytics to gather aggregate usage statistics (e.g., page views, traffic patterns) to help improve our Site’s design and content.

  • Device and Network Information: The Internet Protocol (IP) address of your computer or device, your browser type and version, your device identifier, your operating system, and network provider. It helps us understand where our site traffic comes from (e.g., general geographic regions based on IP) and how users interact with our Site.

  • Cookies and Similar Technologies: We use cookies (small text files stored on your browser) and similar tracking technologies to enhance your experience on our Site. We do not use cookies to collect sensitive personal information or for advertising at this time – our cookies are primarily for functionality and analytics. You can control cookies through your browser settings (see Section 5.5 on Cookies & Tracking for more details).

Information We Do NOT Collect via the Site: We want to emphasize that our Site does not solicit or intentionally collect certain categories of sensitive data:

  • We do not collect any Protected Health Information (PHI) through our website. Do not submit medical history, treatment details, or any health insurance information via this Site. If you become a patient at our clinic, any health information you provide will be handled offline or through secure third-party platforms in compliance with privacy laws (see Section 7 regarding third-party tools). The online forms on our Site are for general inquiries or testimonials only, not for medical intake or personal health records.

  • We do not collect payment or billing information through the Site. Our website currently does not process payments or sell products/services online, so we will not ask you for credit card numbers, banking details, or billing addresses on this Site. (Any payments for services are handled in person or through separate billing arrangements, not via the website.)

  • We do not knowingly collect any information from children under the age of 13. The Site and our services are not directed to minors under 13, and we do not knowingly allow such individuals to submit personal data. If you are a parent or guardian and believe your child under 13 has provided personal information on our Site, please contact us so we can remove it.

5.2 How We Use Your Information

We use personal information collected through the Site for the following purposes:

  • To Respond to Inquiries and Provide Services: If you contact us through the Site (for example, sending a question or requesting an appointment), we will use your contact information and message to reply and provide the information or assistance requested. If you submit a testimonial, we may use the information you provided to contact you about your submission or to post your testimonial (with your consent) on our Site (see Testimonial Policy in Section 6).

  • Site Operation and Improvement: We process usage data and device information to analyze how our Site is used and to improve its functionality and content. For instance, understanding which pages are most visited or how users navigate helps us optimize user experience. We may also use data to debug, fix errors, and maintain the security and performance of the Site.

  • Communications: If you provide your email or phone number, we may send you administrative communications such as confirmations, responses to your inquiries, or updates about our policies. We do not currently send marketing or promotional emails, newsletters, or SMS. If in the future we initiate an email newsletter or promotional updates, such communications will be sent only with appropriate consent or as allowed by law, and with an option to opt-out or unsubscribe.

  • Legal Compliance and Protection: We may use or disclose information as necessary to comply with applicable laws, regulations, legal processes, or enforceable governmental requests. We may also process data to investigate or enforce compliance with our Terms of Use (for example, in cases of suspected fraud, harassment, or security issues), or to protect the rights, property, or safety of our users, patients, or the public.

We will not use the personal information we collect for materially different, unrelated, or incompatible purposes without updating this Policy or obtaining your consent. We retain personal data collected through the Site only as long as necessary for the purposes described above or as required by law.

5.3 How We Share Your Information

Hariri Acupuncture & Wellness respects your privacy, and we do not sell your personal information to third parties. We also do not share your personal data with third parties for their own direct marketing purposes. We may share or disclose information collected through the Site in the following circumstances:

  • Service Providers: We use trusted third-party service providers to perform certain services on our behalf related to the operation of the Site or our business. This includes, for example, website hosting providers, email service providers (for contact form notifications), and analytics services like Google Analytics. These service providers may process personal information as needed to perform their functions (e.g., an email service might process your email address to deliver our reply).   • Third-Party Booking/Records Tools: (See also Section 7.) If you choose to use integrated third-party platforms (for example, clicking a link to schedule an appointment through Jane or SimplePractice, which are third-party patient management systems), your information will be handled by those platforms under their own privacy policies and terms. In some cases, we as a provider receive information from those systems (for instance, your name and contact info when you book an appointment), which we handle in compliance with privacy laws and only use for scheduling and providing services to you. Those third-party platforms are typically HIPAA-compliant and protect any health information you submit to them, but we do not control their data practices, so we encourage you to review their privacy notices.

  • Legal Requirements and Safety: We may disclose personal information if required to do so by law or legal process (such as a subpoena or court order), or in response to a request from law enforcement or a government agency where we believe disclosure is legally required. We may also share information if we believe it is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual illegal activity.

  • Business Transfers: In the unlikely event that our business undergoes a major transaction, such as a merger, acquisition, reorganization, or sale of assets, personal information in our possession may be transferred to the successor entity as part of the transaction. If such a transfer occurs, we will ensure the successor honors the commitments we have made in this Privacy Policy regarding your personal information.

Aside from the purposes and sharing described above, we will not disclose your personal data to third parties without your consent. If we ever need to share your data for additional purposes (e.g., co-marketing with a partner), we will update our Privacy Policy and/or obtain your opt-in consent as required.

5.4 Your Privacy Rights (California Residents)

If you are a resident of California, you have specific rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA, effective January 1, 2023) regarding your personal information. These rights includeoag.ca.govoag.ca.gov:

  • Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, if we are required by law to keep the information or if the information is needed to complete a transaction you requested)oag.ca.gov. Once we receive and confirm a verifiable deletion request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

  • Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about youoag.ca.gov. If you believe any of your information is incorrect or outdated, you may request a correction and we will take commercially reasonable steps to rectify it upon verification.

  • Right to Opt-Out of Sale or Sharing: You have the right to opt out of the “sale” or “sharing” of your personal information. However, we do not sell personal information (and have not done so in the past 12 months), and we do not share personal information for cross-context behavioral advertising purposes as defined by the CPRA. Therefore, we do not provide a “Do Not Sell or Share My Personal Information” link, because we simply do not engage in those practiceswoodlandsacu.com. In the event our practices change, we will update this Policy and provide appropriate opt-out mechanisms.

  • Right to Limit Use of Sensitive Information: The CPRA gives you the right to limit our use or disclosure of sensitive personal information if we collected any (e.g., government IDs, precise geolocation, health information, etc.)oag.ca.gov. Note: Our website does not collect sensitive personal information as defined by the law (such as Social Security numbers, financial account info, precise geolocation, or racial/ethnic origin). If in the future we collect any sensitive info, we will only use it for necessary purposes (e.g., providing services requested by you), and you would have the right to direct us to limit any other use.

  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. This means we will not deny you goods or services, charge you a different price, or provide a different level of quality of services just because you exercised your rights under CCPA/CPRAoag.ca.govoag.ca.gov. We also will not retaliate against you in any way for making privacy requests.

Exercising Your Rights: To exercise the rights described above, you or your authorized agent may submit a verifiable request to us using the contact information in Section 11 (Contact Information). Please include your name, contact information, and specify which request(s) you are making (e.g., data access, deletion, correction). We may need to verify your identity (for instance, by confirming information we already have on file or asking for additional details) before fulfilling a request, in order to protect your information from unauthorized access. We will respond to your request within the timeframe required by law (generally within 45 days for CCPA requests, with an extension of 45 additional days if reasonably necessary and with notice to you). These rights are generally available only to California residents; if you are not a California resident, we will try to honor your privacy requests to the extent required or permitted by applicable law.

5.5 Cookies and Do-Not-Track Notice

Cookies & Similar Technologies: As noted, our Site uses cookies and similar tracking technologies for functionality and analytics. Cookies are small files placed on your browser or device to store information. For example, when you visit our Site, we (through Google Analytics) may set a cookie to recognize your browser and record what pages you visit and how long. This helps us compile aggregate data about site traffic and interactions. You have control over cookies – you can usually set your browser to refuse some or all cookies, or to alert you when cookies are being sent. However, note that if you disable cookies, some features of the Site might not function properly (for instance, videos might not remember your volume setting, etc.).

We do not use cookies for advertising or social media tracking at this time. If in the future we incorporate additional cookies (e.g., for marketing), we will update our Cookie policy accordingly and obtain any necessary consents.

Do Not Track: “Do Not Track” (DNT) is a privacy preference that users can set in certain web browsers to signal that they do not wish to be tracked across different websiteswoodlandsacu.com. At this time, our Site does not respond to Do Not Track signals or similar mechanisms, because there is not yet a universal standard for DNT that all websites follow. However, we treat all users’ data in accordance with this Privacy Policy, and we only use tracking in the limited ways described above (for site analytics and functionality). You can also use browser extensions or privacy settings to control the use of many tracking technologies on websites you visit. Additionally, some third-party tools we use (like Google Analytics) offer their own opt-out options (for example, Google provides a browser add-on to opt-out of Google Analytics tracking). 5.6 Data Security

We take the security of your personal information seriously. In the unfortunate event of a data breach that affects your personal information, we will notify you and relevant authorities as required by law.

We retain personal information collected through the Site for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. For instance, if you submit an inquiry, we may keep a record of our correspondence (including your contact info) for our records and to avoid repetitive communications. We will also retain and use information as needed to comply with legal obligations or resolve disputes. When personal data is no longer needed, we will securely dispose of it or de-identify it.

6. Testimonial Policy and User Submissions

We value feedback from our clients and may feature testimonials or reviews on our Site. If you choose to submit a testimonial or any content (such as reviews, comments, or feedback) through our Site or via email, the following terms apply:

Consent to Use: By submitting a testimonial or any content to us, you grant Hariri Acupuncture & Wellness permission to use, reproduce, publish, and display your submitted content on our website and in other marketing or promotional materials. This includes the right to use your name, initials, or other attribution that you provide along with the testimonial. For example, if you sign your testimonial as “Jane D., Thousand Oaks,” we may post it in that form. No Compensation: Normally, we do not provide any compensation for testimonials. Any testimonial you provide is understood to be voluntary and uncompensated. If we ever offer an incentive (such as a discount or gift) in exchange for a review or testimonial, and we publish your testimonial, we will disclose the incentive in accordance with FTC endorsement guidelines. Absent such disclosure, you can assume no compensation was provided.

Editorial Rights: We reserve the right to review and edit testimonials for clarity, length, grammar, or to remove sensitive information before posting. We will not intentionally misrepresent or alter the substantive meaning of your feedback. Withdrawal of Testimonial: If you have submitted a testimonial and later wish to update or remove it, you can contact us at any time (see Contact Information in Section 11). We will make reasonable efforts to comply with your request, though please allow some time for changes to take effect. Note that we cannot retract content that has already been distributed beyond our direct control (for instance, if a testimonial was featured in a printed brochure or shared on social media by third parties, we may not be able to fully remove those copies).

By submitting any content to our Site, you also represent that you have the right to give us this permission (for example, you are the original author of the testimonial) and that the content does not infringe on the rights of any other person or entity. We appreciate and value your feedback, and we strive to ensure that any testimonials presented on our Site are truthful and not misleading. 8. Accessibility Commitment (ADA & Unruh Act)

Hariri Acupuncture & Wellness is committed to making our website and services accessible to everyone, including individuals with disabilities. We believe in providing equal access and opportunity to all potential users and clients, in accordance with the Americans with Disabilities Act (ADA) and California’s Unruh Civil Rights Act, which prohibits businesses from discriminating on the basis of disability (among other protected characteristics)reciteme.com.
